Terms of Service
Welcome to SermonPush. These Terms of Service ("Terms") govern your use of the SermonPush website, app, and service (collectively, the "Service") operated by Kirk Brown Creative LLC ("we," "us," or "SermonPush"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have the authority to enter into a binding agreement on behalf of yourself or the church or organization you represent. By signing up, you confirm both.
2. Your Account
You are responsible for keeping your password secure and for all activity that happens on your account. Notify us at hello@sermonpush.com immediately if you suspect unauthorized access. We are not liable for losses that result from compromised credentials you did not protect.
3. Your Content
You retain full ownership of all sermons, audio recordings, transcripts, and other content you upload ("Your Content"). By using the Service, you grant SermonPush a limited, non-exclusive, royalty-free license to host, process, transcribe, transmit, and transform Your Content solely for the purpose of providing the Service to you.
You are responsible for ensuring you have the right to upload and process Your Content. Do not upload content you do not own or have permission to use. This includes copyrighted music, third-party speakers, or material licensed by another party.
4. Acceptable Use
You agree not to use the Service to:
- Upload illegal, harmful, defamatory, or infringing content
- Attempt to reverse-engineer, scrape, or bypass technical protections of the Service
- Resell or sublicense the Service without our written permission
- Use the Service to generate content for non-church organizations without permission
- Interfere with the Service's performance or attempt to overwhelm our infrastructure
5. AI-Generated Content
The Service uses third-party artificial intelligence systems (including Anthropic Claude and AssemblyAI) to generate transcripts and derivative content from Your Content. AI output may contain errors, omissions, or theological inaccuracies. You are responsible for reviewing all output before publication or use. We do not guarantee accuracy, doctrinal soundness, or fitness for any specific purpose.
6. Payment and Billing
Paid plans are billed monthly or annually through Stripe. By subscribing, you authorize recurring charges until you cancel. All prices are in U.S. dollars and exclude applicable taxes.
Founding cohort pricing (CHURCHCOMS25): If you subscribed using the CHURCHCOMS25 promotional code, you receive 50% off the Starter or Growth monthly plan for the lifetime of your subscription, provided your subscription remains continuously active. If you cancel, downgrade, or your subscription lapses for any reason, the founding price is forfeited and you will pay standard rates upon resubscribing. This promotional code applies to monthly plans only.
7. Refunds and Cancellation
7-day money-back guarantee: If you are not satisfied within 7 days of your first paid charge, email hello@sermonpush.com and we will refund that charge in full.
Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal or by contacting us. After cancellation, you will retain access through the end of your current billing period. We do not provide pro-rated refunds for partial periods after the 7-day window, except where required by law.
8. Service Availability
We aim for reliable, continuous availability but make no uptime guarantees. The Service may be temporarily unavailable for maintenance, updates, or due to issues outside our control (third-party outages, infrastructure failures, etc.).
9. Termination
We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay. You may delete your account at any time. Upon termination, your data may be deleted from our systems within 30 days, except where retention is required by law.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to defend, indemnify, and hold harmless SermonPush, Kirk Brown Creative LLC, and its officers, directors, and employees from any claim, loss, damage, or expense (including reasonable attorney fees) arising out of Your Content, your violation of these Terms, or your violation of any third-party right.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Gaston County, North Carolina, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you by email or in-app notice at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.
